Tenant Terms of Use

1. Acceptance of Terms

These Tenant Terms of Use ("Terms") constitute a legally binding agreement between you, the user ("Tenant," "You," "Your"), and [Your Company's Official Registered Name] ("FlovaHomes," "We," "Us," "Our"). These Terms govern Your access to and use of the FlovaHomes website, mobile application, and all associated services (collectively, the "Platform"). By accessing, Browse, or otherwise using the Platform, You acknowledge that You have read, understood, and agree to be bound by these Terms and our Privacy Policy. If You do not agree with these Terms in their entirety, You must not access or use the Platform.

2. Scope of FlovaHomes Services

FlovaHomes provides a technology platform that connects property owners ("Owners") with prospective tenants for the purpose of renting residential properties. Our services ("Services") include, but are not limited to: providing verified property listings, facilitating communication, offering tools for digital agreement execution, enabling secure online rent payments, and coordinating maintenance requests for properties under our management. FlovaHomes acts as an intermediary and, for certain properties, a property manager on behalf of the Owner. FlovaHomes is not a party to the rental agreement ("Lease Agreement") which is a separate, binding contract between You and the Owner.

3. User Eligibility and Verification

You must be at least 18 years of age and legally competent to enter into a contract to use our Platform. By using our Services, You represent and warrant that You meet these eligibility requirements. You agree to provide accurate, current, and complete information during the registration and tenant screening process, which may include Know Your Customer (KYC) documentation, identity verification, and background checks as required by law and our internal policies. Misrepresentation of any information may result in the immediate termination of Your account and any subsisting tenancy applications.

4. Tenant Obligations and Conduct

As a Tenant using the Platform, You agree to:

• Comply with all terms of the final Lease Agreement entered into with the Owner.
• Make timely payment of all rent, security deposits, and other applicable fees through the Platform.
• Use the rented property responsibly, lawfully, and only for residential purposes as specified in the Lease Agreement.
• Adhere to all society/building by-laws and regulations.
• Promptly report any maintenance issues or damages through the designated channels on the Platform.
• Maintain the confidentiality of Your account credentials and take full responsibility for all activities conducted through Your account.

5. Fees and Payments

All payments, including but not limited to the security deposit and monthly rent, shall be made through the payment gateways provided on the FlovaHomes Platform. You agree to abide by the terms and conditions of our third-party payment providers. FlovaHomes acts as a collection agent on behalf of the Owner for properties under our "Total Care" management and is not liable for any payment disputes between You and the Owner, although we may provide mediation assistance as a service.

6. Intellectual Property

All content, software, branding, logos, and intellectual property on the Platform are the exclusive property of FlovaHomes and its licensors. You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes. You may not copy, reproduce, modify, or distribute any content from the Platform without our express written permission.

7. Limitation of Liability and Disclaimer of Warranties

The Platform and its Services are provided on an "as is" and "as available" basis. FlovaHomes makes no representations or warranties of any kind, express or implied, as to the operation of the Platform or the information, content, or materials included therein. To the fullest extent permissible by applicable law, FlovaHomes disclaims all warranties. We do not warrant that the Platform will be uninterrupted, error-free, or secure. In no event shall FlovaHomes be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with Your use of the Platform or any tenancy agreement You enter into.

8. Indemnification

You agree to indemnify, defend, and hold harmless FlovaHomes, its directors, employees, affiliates, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or in any way connected with (i) Your use of the Platform, (ii) Your violation of these Terms, or (iii) Your violation of the Lease Agreement or any applicable laws.

9. Termination

FlovaHomes reserves the right, in its sole discretion, to suspend or terminate Your account and access to the Platform without prior notice for any violation of these Terms or for any other reason. The termination of Your access to the Platform will not affect any rights or obligations arising under any Lease Agreement You have entered into.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India.

11. Modification of Terms

We reserve the right to modify these Terms at any time. We will provide notice of such changes by posting the revised Terms on the Platform and updating the "Last Updated" date. Your continued use of the Platform after such changes constitutes Your acceptance of the new Terms.
